Terms & Conditions

The General Terms and Conditions (T&Cs) of art of motion training in movement (henceforth art of motion) apply to all art of motion events, i.e. basic training courses, advanced training courses, intensive courses, workshops and assessments (henceforth Course) and products, i.e. DVDs, Vimeo on Demand videos, books and other study materials, merchandising products (henceforth Product).

Courses

Enrolment

Enrolments are accepted in writing as well as verbally and are binding. Course registrations are always confirmed in writing.

Lateral Entry

Lateral entry is possible any time, if the participant can show the respective certificates / diplomas from completed courses at other institutes; these documents must be enclosed with the registration.

Course Confirmation / Course Cancellation

art of motion reserves the right to cancel a Course up to one week (7 days) before the course starts. In such a case, the registered participants will be informed immediately, and the paid course fee will either be fully refunded or, if requested, credited to another course. No further compensation can be claimed from art of motion.

Change of Educator

If for important reasons a Course cannot be run by the specified educator, art of motion reserves the right to change the dates, cancel the Course, or use other qualified educators. In such a case, the registered participants will be informed immediately of the change. In the event of a postponement or cancellation, the participant may either receive a full refund of the course fee paid or, if desired, have it credited to another course. No further compensation can be claimed from art of motion.

Force Majeure

art of motion shall not be liable or deemed to be in default for any delay, interruption or failure in performance of its obligations under this agreement to conduct a Course due to force majeure, caused for example directly or indirectly by fire, flood, earthquake, explosion or other casualties, strike or labour dispute, disruption of telecommunication systems, war or other acts of violence or terrorism, accident, malfunction of machinery or apparatus, any law, order, injunction, proclamation, regulation, ordinance, demand or requirement of any government authorities, or any other cause or condition whatsoever beyond the reasonable control of art of motion, provided that the participant is notified immediately in writing of the reason for the delay, interruption or failure.

Payment Terms

After registering, the participant receives written confirmation as well as an invoice by email. Upon request, art of motion will print an invoice and send it by post. The Course fee is to be paid no later than four weeks before the Course starts; that is the date of the receipt of payment into art of motion’s account. The current tuition fees are listed on the art of motion website at www.art-of-motion.com.

Early Bird Discounts

Participants can benefit from an early bird discount if they pay the Course fee by the defined early bird cut-off date (usually 8 weeks before the Course starts); again, the date of the receipt of payment into art of motion’s account applies. If the Course fee payment arrives into art of motion’s account after the early bird cut-off date, the regular Course fee will be charged.

Repeating Courses

Those who have already attended a Course with art of motion may repeat the same Course to the same extent at a reduced price. In general, the reduction is 40% of the full Course price. A definitive confirmation and admission to the Course takes place two weeks before the Course starts.

Cancellation & Rebooking

Participants can cancel their registration or rebook a Course in writing, by email or post. A cancellation or rebooking will incur a fee. 

Cancellation Provisions

The cancellation fee (regular course price) depends on the time of cancellation:

Rebooking Provisions

The rebooking fee depends on the time of rebooking:

Illness & Accident

In the case of illness or accident-related no-shows/cancellations supported by a medical certificate, the missed portion can, in the best case, be rescheduled for a later date or the difference of the Course fees will be refunded.

Face-to-Face and Live Online Teaching

art of motion Courses - online learning courses excluded - are designed to teach a subject in face-to-face and live online classes, and allow students to deepen and consolidate what they have learned with in-depth course material by self-studying.

Presence Requirement

The Course is considered as completed if the participant has attended at least 80% of the face-to-face or live online class. In agreement with the art of motion office, missed lessons can be made up for in order to obtain a certificate of participation.

Certificates & Diplomas

After a Course is completed, the participant receives a certificate free of charge, after successful examination a certificate (Pilates) respectively a diploma (Slings Myofascial Training). For the renewed delivery of certificates, diplomas, caused by loss or caused by misrepresentation, a fee of CHF 40.- per certificate will be charged.

Waiver

Your participation in any event by art of motion is at your own risk and responsibility. Participants should be aware that Course units involve physical activity and exertion and therefore accept full responsibility for any injury, loss or damage to themselves or their property. Fines, prosecution and/or claims for damages against art of motion as well as its organisers, instructors, assistants, exam experts and participants will be waived.

Insurance

art of motion assumes no liability for injuries/accidents and/or damage occurring during events. Each participating individual is personally responsible for having adequate insurance coverage. Swiss law applies, the place of jurisdiction is Berne.

Photo & Video Recording

Participants are not permitted to make video recordings during Courses. Photos can be taken if the educator agrees, but they cannot be used for commercial purposes. Photo and video materials taken during Courses and produced by art of motion can be used by art of motion. They may appear in internal training materials or in publications for print media or electronic channels. The educator will inform the participants in advance about recordings. The participant has the right that no photo or video recordings of him / her are made.

Products

Delivery

art of motion reserves the right to deliver ordered Products only after full payment has been received.

Return & Exchange

art of motion Products are generally excluded from exchange, unless the delivered Product has demonstrably significant defects that make the appropriate use impossible.

General Complaints

Complaints can be sent by e-mail to the art of motion customer service: welcome@art-of-motion.com. Customers who submit complaints will be contacted within 5 working days. art of motion takes complaints seriously and strives to find an amicable settlement as soon as possible. Decisions for failing an exam may be subject to a written appeal within 14 days. Here, too, an answer from art of motion can be expected within five working days.

Data Protection

The protection of privacy in the processing of personal data is an important concern of art of motion. Personal data will be processed according to legal regulations.

Third Parties

Basically, no data will be passed on to third parties. Exceptions to this are authorities, such as the tax administration, which has a legitimate claim to certain data.

Information & Erasure

Interested parties, customers can be provided with information about which of their personal data is stored by art of motion and request the erasure of the same, provided that there is no legally required retention (payment data).

Copyright

All art of motion documents, texts, images, graphics, audio and video files are protected by copyright and other intellectual property laws. The further use of all kinds, in particular duplication or passing on to third parties, requires the written approval of art of motion. If the copyright of art of motion or third parties is violated, the participant, regardless of the degree of negligence and a limitation of liability per incident, owes a contractual penalty of CHF 4'000. The payment of the contractual penalty does not exempt from the obligation to respect the copyright in the future, respectively to meet the requirements or to refrain from the injury in the future. art of motion reserves the right to assert further damage.
